วันนี้ถือเป็นวันครบรอบ 2 ปี ที่กรมอุทยานแห่งชาติ สัตว์ป่า และพันธุ์พืช บุกเข้าตรวจค้นวัดเสือที่จังหวัดกาญจนบุรี และได้ทำการขนย้ายเสือ รวมถึงสัตว์ป่าคุ้มครองอื่นๆ ออกจากวัด หลังจากที่มีการค้นพบการซุกซ่อนสัตว์ป่า

ผิดกฎหมายไว้เป็นจำนวนมาก อาทิ นกเหงือก หมาจิ้งจอก และหมีควาย ซึ่งทางวัดไม่มีใบอนุญาตครอบครอง การแสวงหาผลประโชยน์จากเสือ การทารุณกรรมและนำสัตว์มาแสดงในทางที่ผิด อีกทั้งยังมีหลักฐานเสือสามตัว

ที่หายออกไปจากวัดเพื่อส่งต่อไปยังการค้าเสือตลาดมืด การสืบค้นในสัปดาห์ต่อมาเจ้าหน้าที่กรมอุทยานฯ

ยังพบสัตว์แช่แข็งอีกเป็นจำนวนมาก เช่น เสือและหมีขอที่พนักงานวัดได้ซ่อนไว้ในตู้แช่แข็งด้านหลัง

และเหตุการณ์ที่เจ้าหน้าที่กรมอุทยานฯ สกัดรถที่มีพนักงานและพระภิกษุสงฆ์กำลังขับหลบหนีออกจากวัด เมื่อตรวจค้นภายในรถยังค้นเจอเครื่องรางของขลังที่ทำมาจาก เขี้ยวเสือ หนังเสือ ตะกรุด อีกเป็นจำนวนมาก

ซุกซ่อนอยู่เหตุการณ์เหล่านี้คือสิ่งที่เกิดขึ้นเมื่อสองปีก่อน

สัปดาห์นี้ทางมูลนิธิเพื่อนสัตว์ป่าได้สอบถามถึงความคืบหน้ากับทางเจ้าหน้าที่ตำรวจ และพนักงานอัยการ ทางเราได้รับคำตอบว่า จนถึงขณะนี้ยังไม่มีพนักงานแม้สักคน หรือพระแม้สักรูปที่ถูกดำเนินคดีในชั้นศาล เนื่องจากเหตุผลที่ว่าพยานหลักฐานไม่เพียงพอและคดีมีความซับซ้อนมาก ตามปกติแล้ว คดีลักษณะนี้

จะมีการดำเนินการในชั้นศาลภายในระยะเวลา3 เดือน ดังนั้นเหตุผลที่ทางเจ้าหน้าที่อ้างว่ามีหลักฐานไม่เพียงพอ

ทางมูลนิธิฯจึงเห็นว่าเป็นเพราะไม่มีการดำเนินการอย่างจริงจัง เนื่องจากสัตว์คุ้มครองทุกตัว ได้มีการค้นเจอภายในวัดเสือและเจ้าหน้าที่กรมอุทยานฯ เป็นผู้เคลื่อนย้ายสัตว์ออกมาด้วยตนเอง ดังนั้นแล้ว การที่วัดมีสัตว์ป่าไว้ในครอบครองถือเป็นหลักฐานชิ้นสำคัญที่สุดในการนำผู้กระทำผิดมาลงโทษ

และเมื่อครั้งที่เจ้าอาวาสกล่าวว่าไม่เคยเห็นนกเหงือกในวัดมาก่อนและไม่รู้ว่านกมาอยู่ในวัดได้อย่างไร

นกจำนวนมากแออัดอยู่ภายในกรงสูง 12 เมตร ตรงบริเวณทางเข้าวัด แล้วเจ้าอาวาสปฏิเสธว่าไม่เคยเห็นเลย จะเป็นไปได้เชียวหรือ

อย่างไรก็ตาม เมื่อวันที่ 1 มิถุนายน 2561 ทีมงานของทางมูลนิธิ ฯ ได้ใช้โดรนเข้าไปสังเกตการณ์ภายในวัดเสือ

เพื่อดูความคืบหน้าของการก่อสร้างกรงเสือ ภายใต้บริษัทที่เปลี่ยนชื่อใหม่ว่า ‘Golden Tiger Co. Ltd’ จากรูปภาพจะเห็นอาคารหลังปัจจุบันที่มีการก่อสร้างอยู่ ซึ่งทางกรมอุทยานฯเอง ยังไม่ได้ให้ใบอนุญาตสวนสัตว์กับบริษัทใหม่ แต่อย่างไรก็ตามใบอนุญาตอาจมีการเปลี่ยนแปลงได้ในภายหลัง หากกรงที่สร้างเสร็จนั้นเป็นไปตามมาตรฐาน

เมื่อผู้ต้องหายังไม่ถูกดำเนินคดีโอกาสที่ทางวัดเสือจะนำเสือตัวใหม่กลับเข้ามาหาผลประโยชน์อีกครั้งในขุมนรก แห่งนี้จึงเป็นไปได้สูงมาก อย่างไรก็ดี ทางมูลนิธิ ฯ ขอยกย่อง นายอดิศร นุชดำรงค์ รองอธิบดี กรมอุทยานฯ ที่นำทีมเจ้าหน้าที่ปฎิบัติการอย่างจริงจังเมื่อ 2 ปีที่แล้ว อีกทั้งยังถูกกล่าวหาจากทีมทนายความของทางวัด

ถึงกระนั้นทางมูลนิธิฯยังคงขอร้องเรียนแก่หน่วยงานต่างๆที่เกี่ยวข้องให้ดำเนินการทางกฎหมายเพื่อที่จะได้นำ เจ้าอาวาสและผู้เกี่ยวข้องในการกระทำครั้งนั้นทุกคนมาดำเนินคดีในชั้นศาล ทางมูลนิธิเพื่อนสัตว์ป่าจะยังคงสู้เพื่อกระบวนการยุติธรรมของสัตว์ต่อไปและหวังว่าทางอุทยานฯ จะไม่อนุญาตให้มีการนำเสือมายังวัดเสืออีกครั้ง

This week marks exactly two years since the Department of National Parks (DNP) raided the Tiger Temple in Kanchanaburi and removed all tigers and other protected wildlife, after evidence of rampant illegal wildlife trade and animal abuse was found on site. The temple had illegally obtained dozens of protected hornbills, jackals and bears without any registration with authorities, putting these animals on display at the temple. Besides this tigers at the temple disappeared into the illegal wildlife trade. During the second week of the raid authorities even found dozens of frozen dead animals such as tigers and binturong hidden away in backroom freezers, amulets made of tiger teeth and furs were found in a car being driven by staff and monks out of the temple, trying to elude authorities.

WFFT asked for an update with the police and prosecutors office this week, but were told “off-the-record” that until now not one person was brought to court due to lack of evidence and the case being too complicated. In normal circumstances the case would have been presented to the courts within 3 months.

In our opinion the reasoning of lack of evidence can not be taken seriously, as all protected animals except for the jackals were found on site of the temple and were taken in by the DNP, therefore having solid evidence of illegal possession and trade by the temple. The abbot claimed he had never seen the hornbills at his temple and had no idea where they came from. We wonder how he never did see the 12-meter-high cage full of birds at the entrance of his own temple…

The WFFT’s investigations team visited the Tiger Temple on the 1st of June 2018 to check on developments of the new zoo which is being constructed by a company under the name of ‘Golden Tiger Co. Ltd’. As you can see from the drone images the new zoo is currently under construction. Permission is yet to be granted for tigers to be housed at the new zoo, however this may be granted when the new zoo is completed. Until the criminals are charged there is still a big chance that tigers will once again return to this hell hole.

We commend the DNP for there actions taken two years ago, especially the at this time Deputy Director-General Adisorn Noochdamrong, who was charged on several accounts of slander by the temple’s legal team. At the same time, we hereby again request other departments to no longer undermine the legal process and get the abbot and his accomplices charged in court. We will continue to fight this establishment and hope that tigers never return.
